Japan Releases Guidance on Revision of Chemicals Control Act

The Ministry of Economy, Trade and Industry of Japan (METI) recently released the provisional English translation of the Chemical Substance Control Law (CSCL). It also includes the temporary review of the procedures for the notification and the provisional English version of the guidance document for the implementation of the revised law. The revised version of the Japan Chemical Review Act will take effect on April 1.

The revision of the Japan Chemical Review Act was approved in 2009 and is currently implemented in two phases: the first phase is effective on April 1, 2010; the second phase is effective after 12 months, April 1, 2011. In the second phase, the law requires that if the company produces or imports more than one ton of chemicals per year, it must report annually on April 1, 2011, the data on the hazardous materials and its uses. Based on these data, the Japanese government will conduct material screening on data on environmental exposure and harmful information, and use the available harmful information to create a list of chemical substances for priority assessment.

According to the notified guideline document, the revised chemical safety management will be changed from harmful to risk-based management approaches, so exposure data will be an important element in the assessment. The methods for screening and selecting substances for priority evaluation must be approved by the Japanese government’s economic and trade industry department as well as the environment and health department. The document states that the preferred substances will be announced in the official gazette on April 1.
