On February 3, the Legal Affairs Office of the State Council issued the Regulations on the Administration of Recall of Defective Automobile Products (Draft for Soliciting Opinions) (hereinafter referred to as the “opinion”), clearly stating that: Producers of automotive products are responsible for recalls; tire manufacturers who are not equipped with vehicle defects are responsible for the recall.

The introduction of a blank draft for filling domestic automobile recalls filled the gap in the domestic automobile recall and changed the embarrassing situation in which no responsible party could be found in the past regulatory history. In the past, there was no clear “Three Guarantees” regulation for tires in China, and the warranty for tires was also separate from the whole vehicle, and there were no detailed implementation rules.

“Because tires are highly relevant to safety, they are large in quantity and costly. If the company does not recall it in time, it is very difficult to identify the responsibility after the accident. It is impossible to determine whether the accident was caused by the tire problem or the tire was damaged due to the accident. The social concerns caused by lake tires and other incidents have brought tires into the recall regulations."J. D. The Opinions stipulate that the recall regulations are “upgraded” into laws and regulations by departmental regulations, and that any unit or individual may complain to the quality inspection department of the State Council about possible defects in the automotive products, which expands the subject of claims, including any associations, lawyers, etc. Units and individuals have the right to complain, which in turn increases the power of consumers. At the same time, in the case of serious circumstances, it was ordered to suspend business for rectification and aggravate it to “revoke the permit”. It can also be seen that the actual punishment will be more stringent and easier to implement.

The data from the China Consumers Association shows that in 2010, complaints from the automotive industry increased by 51.1% year-on-year, a record high, and the largest increase was recorded in all complaints. “The quality issues that were exposed before were decided by the Bureau of Quality Supervision on whether to recall it. The question is whether the company is voluntary. Now it is a mandatory measure, and the scope of application is wider.” Zeng Zhiling told reporters.

In 2010, Toyota Motor announced the recall in the world. At that time, Toyota did not accept the requirement of providing corresponding financial compensation for consumers because China's “Regulations on the Recall of Defective Automobile Products” did not provide for the corresponding expenses for consumer defects. "This year's recall of the Toyota Motor Vehicles in China reflects the two issues that do not fully reflect national treatment and penalties." The draft of the domestic brand recall request is not strict. The regulations are applicable to the recall and supervision of automobiles and automobile trailers produced and sold in China. Producers should bear the cost of eliminating defects and the necessary for transporting defective automobile products. cost.

According to the recall notice issued by the China Automobile Recall Network, a total of 95 domestic recalls were conducted in 2010, involving 1.17 million recalled passenger cars, which accounted for only 6.5% of the 18 million new car sales in 2010. The major recalled depots were joint ventures, including luxury brands such as Bentley, Mercedes-Benz and BMW. Among them, only one domestic brand, the Chery Ruilin X1, recalled 3,200 vehicles, which accounted for only 0.2% of the total domestic passenger car recalls in 2010. .

The industry believes that the automobile recall system has been very common in the world, but the implementation of the automobile recall system is relatively late in the country, the relevant standards are still not perfect, and the recall requirements are not strict, which is the main reason that causes domestic automobile brands to be rarely recalled. . In mature countries such as the United States and Japan, the recall system is in the form of laws. It has strong authority and binding force. If serious accidents occur due to automobile defects, the legal punishment will be severe. Therefore, once the car company found that the car is defective, it will often recall itself.
